Abstract

Article 80 recalls the obligations concerning the registration and publication of treaties but is silent on the subject of sanctions upon non-registration. Article 80 emphasises the role of Article 102 and aims to consolidate the central system of registration within the UN. It provides that treaties shall, after their entry into force be transmitted to the Secretariat of the United Nations. The treaty is submitted to the UN Secretariat for registration or filing and recording, as the case may be, and for publication. It reflects a customary rule and it also concerns non-Convention parties. The term registration applies to UN Members, filing and recording concerns non-members. Article 80 usefully provides that the designation of a depositary shall constitute authorisation for it to perform the acts specified. Article 80 is silent on the matter of sanctions in case of non-registration.
