Chapter 2 analyses the arbitrator-made rules that relax the procedural aspects of consensual jurisdictional regulation, that is the conditions of access defined by disputing parties. It addresses the rules introducing the concept of admissibility and relaxing the rigidity of conditions of access, the avenues for bypassing conditions of access, and the attempts at creation of a presumption governing the applicability of mfn clauses to dispute settlement clauses.
