Chapter 3 analyses the arbitrator-made rules that relax the substantive aspects of consensual jurisdictional regulation, that is the substantive limits of arbitral jurisdiction defined by disputing parties. It addresses the rules that do so in a temporal dimension regarding denial of benefits clauses and time-bars, the rules affecting the scope of protected investors and investments, as well as the permissibility of jurisdictional bridging which affects the scope of arbitrable disputes.
