This chapter traces the role of the courts in Pakistan in declaring environmental rights as rights fundamental to the right to life and dignity. Through public interest litigation and exercising suo motu jurisdiction, the Supreme Court of Pakistan has actively addressed environmental issues and declared the right to a clean and healthy environment as a fundamental right under the Constitution of Pakistan. In addition, the courts have emphasized the importance of procedural rights, particularly the role of regulatory bodies in protecting and preserving the environment. With a growing focus on climate action, the courts have encouraged taking adaptive measures, raising awareness, and formulating effective policies. Once again, the courts have emerged as key catalysts in placing the pressing challenge of climate change at the forefront of national discourse.
