The Roman jurists used rhetorical devices such as topoi and theseis when creating arguments to support their opinion on a thorny legal problem. This, in a nutshell and contrary to mainstream scholarly opinion, is what we have argued for over two decades, and in this book we have sought to present our case by studying the Digest and Cicero’s Topica – in relation to one another. This unusual approach has enabled us to identify twenty regulae in title D. 50.17 that we believe are arguments designed for one particular case, based on topoi, and formulated in general terms as theseis.
