Abstract

The status coniectura, pertaining to disputes about sit ne (whether something is), suits five regulae and in each case the argument derives from the topos causa. For four regulae we could find the lex geminata: Ulp. D. 50.17.13, Ulp. D. 50.17.31, Ulp. D. 50.17.35 and Paul. D. 50.17.180. The context of Paul. D. 50.17.167.1 has not been preserved, but a striking resemblance to Ulp. D. 39.3.4 pr. suggests that it provided an argument for a case similar to that described by Ulpian.
