Human rights may ground peoples’ legal challenges to energy activities. This contribution examines this legal scenario by way of a threefold analysis. It first briefly discusses peoples’ entitlement to permanent sovereignty over natural resources and subsequently clarifies which type of human rights, both substantive and procedural, may be impaired by energy activities – together with correlated obligations. In the energy sector, multiple actors engage at different levels in energy projects, also eventually contributing, through their acts or omissions, to harmful outcomes and to violations of peoples’ rights. In this context, the article will conclude by identifying the main issues and challenges related to shared responsibility for human rights violations.
