Zusammenfassung
Rechtsvergessenheit, ignorantia iuris, begegnet in der Kirche auf vielfältige Weise. Ausgehend von LG 5, 2, wonach die Kirche Keim und Anfang des göttlichen Reiches der Gerechtigkeit, der Liebe und des Friedens sein soll, werden drei Thesen zur ignorantia iuris entwickelt. So wird zuerst gezeigt, dass das Konzil ohne Kirchenrecht belanglos bleibt. Als zweite These wird dargelegt, dass die Rechtsvergessenheit das Ziel der Kirche gefährdet. Und mit der dritten These wird deutlich, dass eine Kirche, die Schwache vor Willkür schützen will, auf die gute Kenntnis des Rechts und auf seine barmherzige Anwendung angewiesen ist.

Oblivion of law, ignorantia iuris, occurs in the Church in different ways. Based on LG 5,2 according to which Church is the initial budding forth of Christ’s and God’s kingdom of justice, charity and peace, the author develops three main approaches: First, the Council remains ineffectual without Canon Law. Then, the author shows, that oblivion of law endangers the purpose of the Church. Finally, a Church that is seeking to protect weak persons from arbitrariness relies on good knowledge of law and on its merciful application.

L’oblio della legge, ignorantia iuris, è un fenomeno assai diffuso nella Chiesa. Secondo la LG 5, 2 però la Chiesa in terra costituisce il germe e l’inizio del regno di Cristo, cioè del regno della giustizia, dell’amore e della pace. Partendo da questa affermazione il contributo sviluppa tre tesi circa la ignorantia iuris: La prima tesi illustra, che il Concilio senza il diritto ecclesiastico non guadagna nessuna importanza pratica. La seconda tesi spiega, che la meta della Chiesa con l’oblio della legge viene messo in rischio. E la terza tesi mette in rilievo, che la difesa dei deboli e dei poveri dall’arbitrio di altrui richiede necessariamente sia la buona conoscenza della legge sia la sua applicazione misericordiosa.
