Zusammenfassung
Can. 1734 § 3 Nr. 1 CIC wird in der Doktrin unterschiedlich interpretiert. Diese theoretische Frage beinhaltet enorme praktische Relevanz. Je nach Rechtsauffassung kann nämlich die Annahme der Verwaltungsbeschwerde seitens des hierarchischen Oberen gewährt oder verwirkt werden. Das hier veröffentlichte und kommentierte Endurteil der Apostolischen Signatur zeigt, dass General- und Bischofsvikar nicht unter besagte Norm subsumiert werden.

Can. 1734 § 3, n. 1 CIC is interpreted differently in the doctrine. This theoretical question involves enormous practical relevance. Depending on the interpretation of the law can the hierarchical recourse be accepted or rejected by the superior. The here published and commented final sentence of the Apostolic Signatura shows that General and Episcopal Vicar aren’t subsumed under this norm.

Il can. 1734 § 3, n. 1 CIC viene interpretato in modo diverso nella dottrina. Questa questione teorica comporta enorme rilevanza pratica. Finora l’ammissione di un ricorso gerarchico da parte del Superiore gerarchico dipendeva dal suo punto di vista giuridico su questa domanda aperta. La sentenza definitiva della Segnatura Apostolica, pubblicata e commentata, mostra che il Vicario generale ed il Vicario episcopale non sono inclusi in questo canone.
