Abstract

In an action filed before the Dubai Court of Cassation it was held that under the UAE Maritime Code the party who signed and issued the bill of lading will be liable for any damage caused to the goods. This party need not be the owner of the vessel. If the owner of the vessel did not sign or issue the bill of lading, he will not be liable for the damaged goods and the charterer will therefore be solely liable for the goods and any claim made for loss or damage to the goods.
