Article 6, Section 1 applies to costs proceedings if the costs at issue were incurred in the determination of civil rights and obligations. The principle of equality of arms requires that each party should be afforded a reasonable opportunity to present his case under conditions that do not place him at a substantial disadvantage

his opponent. Each party must be given the opportunity to have knowledge of and comment on the observations filed or evidence adduced by the other party.
