Abstract

A uniform federal soil protection act has not been adopted until 1998.1 The Act primarily focuses on the clean-up of inherited pollution and contains only few preventive regulations concerning soil protection. Preventive instruments are predominantly integral parts of other laws. This article gives a review of the structure of the soil protection law in Germany and introduces the core regulations of the Federal Soil Protection Act. Furthermore, the article discusses the issue of liability for inherited pollution according to German civil law.
