Abstract

Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) introduces a specific regime for the registration of Substances in Articles. This paper demonstrates how REACH fills a gap in the current legislation, without double regulation, reviews how the relevant elements of REACH were developed, concludes there is no trade issue with REACH, and looks in detail at the relevant elements of REACH's regulatory framework for substances in articles. It is clear that the REACH provisions are proportionate and non-discriminatory and concludes that REACH is a step in the right direction but does not cover all substances in articles and so ensure a very high standard of health and environment protection.
