Abstract

The year 2004 was an active year for both the filing and rendering of decisions in investor-State treaty-based arbitrations. New decisions addressed a wide variety of issues relating to the jurisdiction and admissibility of claims under international investment treaties, as well as the coverage and meaning of their substantive provisions. This article analyzes the decisions issued in 2004 by investor-State tribunals and in annulment proceedings. It also describes developments occurring during the year concerning transparency and accountability in investor-State arbitration.
