Even if the root ṣby is well-attested from the first millennium b.c.e. onwards, there is no evidence for such a legal formula prior to the 1st-3rd centuries c.e. The phrase wkʿt kl zy tṣbh šlḥ ly “And now, whatever you desire, send (word) to me“ (B. Porten/A. Yardeni (eds.), tada I, (Winona Lake, 1986), p. 16; cf. D. Schwiderski (ed.), The Old and Imperial Aramaic Inscriptions II, (FoSub 2; Berlin/New York, 2004), p. 2), which is attested in a letter dated between the late 6th and the early 5th centuries b.c.e., cannot be deemed as an exception. It is the only reference from the first millennium b.c.e. having some formal similarities with the three phrases cited by Hurvitz. But it is not used in a legal context, and it does not have any of the characteristics of a formula. This is further evidence against the assumption that a legal formula already existed in the first millennium b.c.e.
