Ognevenko v. Russia: A New Brick in the Wall between ECtHR and the Russian Constitutional Court

The present chapter is dedicated to the legal methods of addressing harassment and mobbing, based on non-discriminatory ground. The contribution of other social sciences to the struggle with these issues will be evidenced as an encouraging factor for the development of employee’s protection. National systems of employment legislation provide three main ways of protection from harassment and mobbing– by special anti-harassment legislation (France); by using safety at work norms which also oblige the employer to create a psychologically healthy workplace (Italy); by tort-law, prohibiting humiliating conduct in the society (the USA). A brief overview of peculiarities of each system is done in the chapter. Conclusions on shortcomings of each system and brief vision of the ways of development in this area are made in the end.
