Subject Highlights

Since 1 January 2017, the crime of aggression is defined as an offence under German law. The paper introduces the new Section 13 of the German Code of Crimes against International Law, explains its basis in international law, constitutional law and criminal policy and identifies differences and similarities compared to article 8bis of ICC Statute. The paper argues that the new offence may serve as an inspiration and model for other states considering the implementation of the Kampala amendments.
